HIGH COURT SUCCESS FOR CITY 20/09/2007
Blue Square South club Cambridge City have succeeded in their High Court claim to have their interest in their Milton Road ground reinstated.
The club will now have a lease of Milton Road running to 2010 and can share in 50% of future profits from development of the site.
In a judgement delivered on Wednesday, Justice Briggs agreed with the club that it had been the victim of a fraudulent misrepresentation made by a representative of Ross River. His Lordship said: ‘the club is entitled to rescind the Overage Agreemen - having been induced to make it by a fraudulent misrepresentation for which Ross River are responsible’. The club is taking up this option.
Speaking about the verdict, City chairman Kevin Satchell said: “It`s wonderful news. The club’s future has been on a knife edge for some time and this judgement gives us some security and an opportunity to plan ahead. A huge amount of work has gone into this and it has paid off – the Judge has accepted our case that there was fraudulent misrepresentation.”
Fans’ director Rab Crangle said: “I’m overjoyed. The new directors have spent the best part of 18 months on this issue and showed considerable nerve and determination in seeing it through. During this time the club faced great danger, including the threat of eviction, but we have overcome this.
“We were buoyed by the solid support we had from fans and shareholders – they were determined not to allow the club to die. I can’t wait for the rest of the season, but this result was more important than any on the pitch.”
The first stage of the ground sale in October 2004 remains in place – but City have restored both the five year lease which entitles them to stay at Milton Road until 2010 and their entitlement to share in the profits of any future development of the site.
